As of August 2017
B2X Care Solutions GmbH (hereinafter “B2X”; find information on B2X here) is pleased you have visited our website. Data protection and data security when using our website is very important to us, so we would like to advise you here what personal data of yours we record when you visit our website and what we use it for.
Since changes to the law or changes to our internal company processes may require an adjustment of this data protection declaration, we ask you to read it regularly. This data protection declaration can be accessed under Data Protection Declaration, saved and printed at any time.
1 Scope of application
This data protection declaration applies to the Internet offering of B2X, which is accessible under the domain motocare.b2x.com and the various subdomains (hereinafter “our website”).
2 What is personal data?
Personal data is information that can be used to access personal or factual circumstances about you (e.g. name, address, telephone number, date of birth or email address). Information we cannot associate with you (or only with disproportionate effort), e.g. by anonymizing the information, is not personal data.
3 What personal data do we collect/process and use?
Our website can always be used without giving personal data.
Non-personal access data is stored, such as the name of your Internet service provider, the page from which you have visited us, the name of the files requested and the dates they were accessed. This data is evaluated exclusively to improve our offering and cannot be used to identify you.
However, if you make use of the services offered on our website – such as the repair of your device or diagnostic service – you will be required to submit further information. This will be the information necessary to process the relevant request.
We use the data we record about you to provide the services we offer, to answer your questions and to operate and improve our websites and applications.
In addition, you can also make use of additional offers/services via our website such as:
The purchase of service plans for your device, e.g. warranty extensions (e.g. of Motorola)
For this purpose we will integrate adverts into our website, which you can then use to view the offers and submit your data yourself to the corresponding provider. Additionally on Motorola’s behalf, we provide them with your personal data to provide offerings like device insurance, warranty extensions, accessory sales or device upgrades.
Your personal data is not used for any other purpose. Your personal data is not transferred to third parties nor is your data used for advertising purposes without your permission with the exception of the cases presented below, unless we are legally obliged to disclose data (disclosure to prosecuting authorities and courts; disclosure to public authorities that receive data under statutory requirements, e.g. social insurance institutions, financial authorities etc.) or where we engage third parties who have undertaken to implement our requirements of professional secrecy.
In particular, personal data is used as follows:
a) Sending device for repair and purchasing service plans
We use the data you have given us for device repair to fulfill and process the repair.
We require your IMEI number (International Mobile Station Equipment Identity - device designation) to be able to check whether your device is still within warranty. We will subsequently record your first name and surname, email address and telephone number, delivery and billing address and payment data.
Your email address is used to send you a summary of the order, the procedure for sending the device back to us, the job ID and the parcel stamp.
We use your first name and second name, delivery and billing address to record the repair order and to provide you with e.g. the parcel stamp.
Your payment data is required for the payment process if your device is no longer within warranty.
If, after sending the device back to us, it is determined that despite the information previously given no warranty case exists (e.g. the damage to the device has been caused by you), you will be sent a cost estimate for repair. If you accept this, your payment data is required to process the payment.
If you do not accept this, your payment data will be used to process payment for cost incurred by us (for sending the device to us, inspecting the damage and returning the device).
Your data is in this case passed on to the repair center responsible to you as is necessary for repair and return shipping.
The forwarding agency commissioned with delivery will receive your data where it is required for delivery. To process payments we pass your payment data on to the credit agency Wirecard commissioned with the payment. These companies may use your data exclusively to process the order and not for any other purposes.
Your data is blocked for any further use on completion of the contract and concluded payment and deleted following expiry of tax and commercial retention periods if you have not given your express permission for your data to be used for other purposes.
b) Personal data stored on the device
The repair may cause loss of, or access to, data stored on your device. It is your responsibility to ensure that no personal data belonging to third parties is passed on to us (e.g. photos or contact data) and to save stored data on the device beforehand, and if necessary delete it before sending the device to us.
c) Checking the warranty
If after entering your IMEI number you receive the message that your device is no longer within warranty, you can dispute this.
For this purpose a free chat window will open with one of our assistants in which we will record your first name and surname, email address, postal address, the purchase location, information on the product and receipt (valid proof of purchase).
Our assistant will then check your warranty status once again using the information you have given. Following the check you will be informed by email of your warranty status.
